Terms and Conditions

1. Applicability

These Terms and Conditions (“Terms”) govern the sale and provision of rust removal materials and services (“Services”) by Rust Doctors FL LLC (“Rust Doctors,” “we,” “us,” or “our”) to the customer (“Customer,” “you”).

2. Services

2.1 Services

Services are provided as described in Rust Doctors’ proposal or estimate (“Proposal”).

2.2 Customer Responsibilities

• Provide reasonable access to premises and utilities
• Keep pets and children away from work areas
• Remove valuables and fixtures prior to service
• Provide accurate information and timely approvals

2.3 Performance Dates

All completion dates are estimates only and not guaranteed.

2.4 Property Maintenance

Property maintenance is included in the Customer’s monthly service fee.

2.5 Service Schedule

The number of service visits per month is mutually agreed upon by both parties and specified within the line-item details of the Proposal. These agreed-upon visits form the basis for monthly service scheduling and billing.

3. Price and Payment

3.1 Prices

Prices are set forth in the Proposal.

3.2 Billing Structure

The Customer will be billed monthly based on the agreed irrigation schedule (days per week). Additional irrigation beyond this schedule will incur additional charges. The monthly fee may increase depending on water quality and the volume of chemicals used.

3.3 Equipment Ownership

If the rust prevention equipment has not been purchased by the Customer, Rust Doctors FL LLC retains ownership and will reclaim the equipment upon cancellation of services.

3.4 Annual Price Adjustments

All service agreements include a standard five percent (5%) annual price increase, which is applied on January 1st of each calendar year unless otherwise specified in the Proposal.

3.5 Contract Terms

This Agreement shall have an initial term of twelve (12) months. Following the initial term, either party may terminate this Agreement for any reason upon thirty (30) days’ prior written notice to the other party.

3.6 Taxes

Sales tax applies to all equipment purchases and installation services and will be added to the final invoice in accordance with state and local tax regulations.

3.7 Payment Terms

Residential accounts are due upon receipt and require a valid payment method on file for automatic payment of recurring services and approved add-ons. Approved commercial accounts may be invoiced under Net 30 terms, with payment due within thirty (30) days of the invoice date. Rust Doctors FL LLC reserves the right to suspend services for accounts more than thirty (30) days past due until the balance is paid in full.

3.8 Late Payments and Collection Costs

Late payments may incur fees and interest as allowed by law. Customer is responsible for collection costs.

4. Change Orders

Additional services or unforeseen conditions discovered during work constitute change orders and may result in additional charges.

5. Limited Warranty

Services are warranted for one (1) year after completion, subject to full payment and proper conditions. No other warranties are expressed or implied.

6. Limitation of Liability

Rust Doctors shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for the Services.

7. Indemnification

Customer agrees to indemnify and hold harmless Rust Doctors from claims arising from the use of Services, except in cases of gross negligence by Rust Doctors.

8. Site & Communications

By using our website, submitting forms, or communicating with us electronically, you consent to receive communications from Rust Doctors electronically, including email, SMS, and phone calls related to your services, account, or inquiries.

9. Online Booking Terms

Online bookings are requests for service and are not final until confirmed by Rust Doctors. You agree to provide accurate and complete booking information.

10. Intellectual Property

All website content, text, images, logos, trademarks, and materials are owned by or licensed to Rust Doctors FL LLC and may not be used without written permission.

11. Confidential Information

All non-public information disclosed by Rust Doctors is confidential.

12. Term and Termination

Unless otherwise specified in the Proposal or a more specific written service agreement, services remain subject to the applicable contract term and termination provisions set forth in these Terms.

13. Force Majeure

Rust Doctors is not responsible for delays caused by events beyond reasonable control.

14. Governing Law & Venue

These Terms shall be governed by the laws of the State of Florida. Any legal action shall be brought exclusively in Palm Beach County, Florida.

15. Miscellaneous

• Severability applies
• These Terms constitute the entire agreement
• No waiver unless in writing
• Terms may be updated at any time
